Schedule 3 and Waensila – an important case

The Full Court of the Federal Court has issued a decision which is likely to transform the way that applications for partner visas are assessed in Australia. How often does that happen? Not often. It is one that has the potential to impact the lives of many visa applicants.
The case was Waensila v Minister for Immigration and Border Protection (2016) FCAFC 32 (11 March 2016). 
The Full Court unanimously held that there is no “temporal” limitation on when the compelling circumstances relied on for a Schedule 3 “waiver” must have existed.

Health Waiver – expensive conditions can be overcome

Hepatitis B is quite common in people from some countries and can cause serious issues with visas for Australia. However, a health waiver for PIC 4007 is quite possible and in some situations, we can overcome the PIC 4005 issues.
Hepatitis B is an infection of your liver. It can cause scarring of the organ, liver failure, and cancer. It can be fatal if it isn’t treated. It’s spread when people come in contact with the blood, open sores, or body fluids of someone who has the hep B virus. The good news is that most cases of the disease don’t last a long time. Your body fights it off within a few months, and you’re immune for the rest of your life. That means you can’t get it again.

Health criteria – PIC 4005 and 4007

Family violence and Australian visas

The Australian Government does not tolerate domestic and family violence under any circumstances.
Domestic and family violence are crimes against the law. A person who commits domestic or family
violence can go to jail, whether they are a man or a woman. Domestic and family violence is behaviour or threats that aim to control a male or female partner by causing fear for safety or wellbeing.

Perth man gets 7-years jail for migration fraud.

A West Australian Court convicted Paul Gregory Harrison for stealing, fraud, receiving a fee for providing migration agent services when he was not qualified, for false documents and forging papers.
He was sentenced to seven years’ jail after being convicted over the criminal and migration fraud offences. Harrison received four years’ jail for 26 criminal fraud and stealing offences and three years’ jail 19 offences under the Migration Act. It is illegal to give unregistered migration advice, provide false or forged documents and misleading information to the Department of Immigration and Border Protection.

Fees and charges for Australian visas

Fees for Australian visa have increased rapidly over the past 5 years. For instance a Partner visa lodged in 2010 cost about A$1,750 and now costs A$6,865. Why? Because the fees are Government controlled and they can increase whenever they want to. Sometimes we get advance warning of a fee increase and sometimes they just go up without notice. Australian visa fees and charges go towards the Government costs of Migration and cannot be regulated.

10 year and 3 year visa bans

What happens if the Department of Immigration and Border protection believe you have given false documents in your visa application? Read this story and you can see the huge problems if you give false documents, or even if you think they are OK but the Department does not.  The Department will describe them as “bogus” documents.
